1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "user") and BlephCovered ("BlephCovered," "we," "us," or "our") governing your access to and use of the website located at blephcovered.com and any related services, content, features, quizzes, downloadable materials, and products (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Services.

You must be at least 18 years old to use the Services. By using the Services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding contract.

The Services are intended for residents of the United States only. By using the Services, you represent that you are located in and accessing the Services from within the United States.

2. Description of Services

BlephCovered is an online educational resource that helps consumers understand whether their upper eyelid surgery (blepharoplasty) may qualify for insurance coverage as a medically necessary procedure. The Services include:

• A free interactive quiz that generates a personalized informational report based on publicly available insurance criteria
• A downloadable digital Documentation Kit containing educational materials, templates, and guides
• Educational content, articles, and other informational resources
• Email communications related to the above

BlephCovered is an educational resource only. We are not a medical practice, law firm, insurance company, insurance broker, patient advocacy organization, or billing service, and we do not provide medical, legal, or insurance advice. See Section 7 for important disclaimers.

3. No User Accounts

The Services do not require or offer user account registration. You may interact with the Services by taking the quiz, subscribing to our email list, and purchasing the Documentation Kit, all without creating an account. You are responsible for ensuring that any information you provide through the Services is accurate.

4. Purchases, Payment, and Digital Products

4.1 Product Description

The Documentation Kit is a downloadable digital product delivered electronically via a download link after successful payment. The Documentation Kit is not a physical product and will not be shipped.

4.2 Payment

Payments are processed through Stripe, Inc., a third-party payment processor. We accept Visa, Mastercard, American Express, and Discover. All prices are stated in United States Dollars (USD). By purchasing from BlephCovered, you agree to Stripe's terms of service and privacy policy.

4.3 Price and Availability

We reserve the right to modify pricing, product descriptions, and product availability at any time without notice. Any such changes will not affect orders that have already been placed and confirmed.

4.4 Delivery

After successful payment, the Documentation Kit will be available for immediate download. If you experience any issues with delivery, please contact us at hello@blephcovered.com.

4.5 License to Use the Documentation Kit

Upon purchase, BlephCovered grants you a limited, non-exclusive, non-transferable, non-sublicensable license to download, store, and use the Documentation Kit for your own personal, non-commercial use. You may not:

• Reproduce, distribute, republish, resell, or create derivative works from the Documentation Kit
• Share, transfer, or make the Documentation Kit available to any third party
• Post the Documentation Kit on any website, forum, file-sharing service, or social media platform
• Use the Documentation Kit or any portion of it to provide paid services to third parties
• Remove or alter any copyright, trademark, or proprietary notices from the Documentation Kit

5. Refunds

14-Day Refund Window. If you are not satisfied with the Documentation Kit or believe it does not apply to your situation, you may request a full refund within 14 days of your purchase by emailing hello@blephcovered.com with your order details.

Processing Time. Approved refunds are processed to the original payment method within 5 to 10 business days of approval.

Late Requests. Refund requests submitted more than 14 days after the date of purchase may be declined at our sole discretion.

Abuse of Refund Policy. We reserve the right to deny refunds in cases of apparent abuse, including but not limited to repeated purchases and refunds.

6. Acceptable Use and Prohibited Activities

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the Services in any way that violates any applicable law or regulation
• Submit false, inaccurate, or misleading information through the quiz or any other interactive tool
• Misrepresent symptoms or medical conditions to obtain insurance coverage for procedures that would not otherwise qualify, or use the Services to facilitate insurance fraud
• Use the Services or any materials to provide medical, legal, or insurance advice to third parties
• Reproduce, distribute, resell, or create derivative works from the Documentation Kit without express written permission
• Use the Services to harass, defame, threaten, or make legal threats against any healthcare provider, insurance company, or third party
• Attempt to gain unauthorized access to or interfere with the Services
• Use any automated system to access the Services

Violation of any of these prohibitions may result in immediate termination of your access to the Services.

7. Disclaimers — Please Read Carefully

7.1 No Professional Advice

BlephCovered is an educational resource and is not a medical practice, law firm, insurance company, insurance broker, patient advocacy organization, or billing service. Nothing provided through the Services constitutes medical advice, legal advice, insurance advice, or professional healthcare guidance of any kind.

No physician-patient, attorney-client, or fiduciary relationship is created by your use of the Services. Always consult a licensed physician, attorney, and your own insurance provider before making any healthcare, legal, or insurance decisions.

7.2 No Guarantee of Insurance Coverage

BlephCovered makes no representations or warranties about whether any specific procedure will be covered by any specific insurer. Coverage decisions are made solely by insurance companies based on each patient's individual medical situation, plan documents, policy terms, and the documentation submitted by their healthcare providers.

7.3 No Unauthorized Practice

BlephCovered does not practice medicine, law, or insurance adjustment. Users are solely responsible for determining whether any information applies to their individual circumstances and for consulting licensed professionals before acting on any such information.

7.4 No Warranty of Accuracy or Currency

While BlephCovered makes reasonable efforts to provide accurate educational information, insurance policies, billing codes, clinical guidelines, and regulatory requirements change frequently. Users are responsible for independently verifying any information with their healthcare provider, insurer, and other qualified sources.

7.5 Services Provided "As Is"

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

8. Indemnification

You agree to indemnify, defend, and hold harmless BlephCovered from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms, your use or misuse of the Services, or your misrepresentation of symptoms, medical conditions, or other information to healthcare providers or insurers.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BLEPHCOVERED BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICES, ANY DENIAL OF INSURANCE COVERAGE, OR ANY MEDICAL OUTCOME.

Cap on Liability. In no event shall BlephCovered's total aggregate liability exceed the lesser of (a) the total amount you paid to BlephCovered in the twelve months preceding the claim, or (b) one hundred United States Dollars ($100 USD).

10. Dispute Resolution, Arbitration, and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

10.1 Informal Negotiations

Before initiating any formal dispute resolution, you and BlephCovered agree to attempt in good faith to resolve any dispute through informal negotiations for at least thirty (30) days. Send written notice to hello@blephcovered.com.

10.2 Binding Arbitration

If unable to resolve through informal negotiations, any dispute shall be settled by binding arbitration administered by the American Arbitration Association (AAA) in the State of California.

10.3 Class Action Waiver

YOU AND BLEPHCOVERED AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

10.4 Time Limitation on Claims

Any cause of action arising out of or related to the Services must be commenced within ONE (1) YEAR after the cause of action accrues.

11. Intellectual Property

All content, features, and functionality of the Services are the exclusive property of BlephCovered or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.

12. Third-Party Links and Services

The Services may contain links to third-party websites or services not owned or controlled by BlephCovered. We have no control over and assume no responsibility for third-party content, privacy policies, or practices.

13. Modifications to the Services and Terms

We reserve the right to modify these Terms at any time. The updated version will be indicated by a revised "Last Updated" date and will be effective immediately upon posting. Your continued use of the Services constitutes acceptance of the new Terms.

14. Termination

We may terminate or suspend your access to the Services immediately, without prior notice, for any reason including breach of these Terms. All provisions that should survive termination shall survive, including ownership, warranty disclaimers, indemnification, limitations of liability, and dispute resolution.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of laws principles.

16. Miscellaneous

Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and BlephCovered.

Severability. If any provision is found invalid, the remaining provisions remain in full force.

Waiver. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.

Assignment. You may not assign these Terms without BlephCovered's prior written consent.
